Class size limits and new admission rules drafted for SA schools

New draft regulations setting class size limits and changing school admissions processes have been gazetted by the Department of Basic Education as part of implementing the Basic Education Laws Amendment (BELA) Act.
The proposals cap Grades 1-12 classrooms at 40 learners and Grade R at 30, while changing admission authority rules. Minister Siviwe Gwarube called this a “significant milestone” for the education system. (Department statement)
Gwarube said the reforms aim to strengthen governance and ensure “equality and inclusion” for South Africa’s 13.5 million learners without removing school communities’ power. The department is using a modular approach to implement changes in stages. (Minister statement)
New admission regulations shift final decision-making from School Governing Bodies (SGBs) to provincial Heads of Department (HODs). SGBs will still draft admission policies, but HODs must approve them after consultation. (Draft regulations)
HODs must provide written notice and reasons before overriding SGBs, giving a “reasonable opportunity” for response. Decisions must consider learner interests, school capacity and community needs. (Draft regulations)
Gwarube stressed: “These reforms are not about taking away power from school communities – they are about protecting the rights of every child and ensuring fair, functional education systems”.
Policies must be “rational, fair, transparent,” reflect local demographics and language preferences, and promote equitable access. Language policy changes will be addressed in future regulations. (Draft regulations)
